1. Acceptance of terms
These Terms and Conditions ("Terms") form a legal agreement between you and US Gatewaylist Ltd ("we", "us", "our"), trading as NodMek Academy, governing your access to and use of the nodmekacademy.com website and services (the "Service"). By creating an account or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service.
2. The service
NodMek Academy is a gamified, online programming-education platform. Features include structured courses and lessons, an in-browser code compiler, coding challenges, quizzes, an AI mentor ("Aria") and other AI-assisted learning tools, XP/badges/leaderboards, spaced-repetition review, and community forums. We may add, change, or remove features at any time without liability to you, provided this does not materially reduce the core service you have paid for during an active subscription or credit balance you hold.
3. Accounts & eligibility
- You must be at least 13 years old to create an account. If you are under 18, you confirm you have your parent or guardian's permission to use the Service.
- You must provide accurate registration information and keep it up to date.
- You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at info@nodmekacademy.com if you suspect unauthorised use of your account.
- Each account is for a single individual; you may not share your login credentials or resell access to your account.
4. AI credits & free tier
Registered users receive a free monthly allowance of AI credits (currently 100 credits per calendar month) to use AI-powered features such as the AI mentor, hints, and content generation. Unused free credits do not roll over to the next month. You may purchase additional credits, which are added to your balance and do not expire unless we state otherwise at the time of purchase. Credit costs per feature may change from time to time; we will display the current cost before you use a paid feature where practical.
5. Payments, pricing & cancellation
- Course purchases and AI-credit top-ups are processed securely by our payment provider, Stripe. Prices are shown at checkout and may be in USD or another currency depending on your location and the course.
- You authorise us (via Stripe) to charge your chosen payment method for the purchases you make.
- Digital content & your right to cancel: courses and AI credits are supplied as digital content delivered immediately on purchase. Under the UK Consumer Contracts Regulations 2013, you normally have a 14-day right to cancel a distance purchase — however, by completing a purchase of a course or credits you expressly agree that we may begin supplying that digital content to you immediately, and you acknowledge that doing so means you lose your right to cancel once access/download has started.
- If you believe a charge was made in error, or a course was materially not as described, contact info@nodmekacademy.com within 14 days of purchase and we will review your request for a refund on a case-by-case basis, in addition to any rights you have under applicable consumer law.
- We reserve the right to change prices for new purchases at any time; changes do not affect amounts already paid.
6. Acceptable use
When using the Service, you agree not to:
- Upload or post unlawful, harassing, hateful, defamatory, or sexually explicit content;
- Cheat, exploit bugs, or use automated tools (bots/scripts) to gain XP, badges, leaderboard position, or free credits;
- Attempt to gain unauthorised access to other accounts, our systems, or the AI providers underlying our AI features;
- Reverse-engineer, scrape, or resell the Service or its course content;
- Use the Service to develop a competing product, or to generate spam, malware, or content that infringes another person's rights.
We may investigate suspected violations and take action including content removal, feature restriction, or account suspension/termination (Section 11).
7. Your content & community
"Your Content" means anything you submit to the Service, including forum posts, comments, course ratings/reviews, and code you write. You retain ownership of Your Content. By posting it, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, display, and reproduce it as necessary to operate and improve the Service (for example, showing your forum post to other learners, or your course review on a course page). Be respectful of other learners in forums and reviews — see Section 6 for prohibited conduct.
8. Intellectual property
The Service, including its courses, lesson content, graphics, gamification design, and underlying software, is owned by or licensed to US Gatewaylist Ltd and is protected by copyright and other intellectual-property laws. Purchasing or enrolling in a course gives you a personal, non-transferable licence to access that content for your own learning — it does not transfer ownership, and you may not copy, redistribute, or resell course materials without our written permission.
9. AI-generated content disclaimer
Our AI mentor and other AI-assisted features (hints, code review, quiz generation, explanations) are generated automatically by third-party AI models. AI responses are provided for educational assistance only and:
- May occasionally be incomplete, out of date, or factually incorrect;
- Do not constitute professional, legal, medical, financial, or career advice;
- Should be reviewed and tested by you before relying on any AI-suggested code in a production system.
You are responsible for how you use AI-generated output. We are not liable for decisions made or actions taken in reliance on it.
10. Third-party services
The Service integrates third-party providers, including Stripe (payments), Azure OpenAI/OpenAI (AI features), Google (optional sign-in), and OneCompiler (in-browser code execution). Your use of these integrations may also be subject to that provider's own terms. We are not responsible for the availability or performance of third-party services outside our control.
11. Suspension & termination
You may stop using the Service and close your account at any time by contacting info@nodmekacademy.com. We may suspend or terminate your account if you breach these Terms, engage in conduct listed in Section 6, or if required by law. Where reasonably possible, we will give you notice and an opportunity to resolve the issue first. On termination, your right to use the Service ends immediately; Sections 8, 9, 12, 13, 14, and 16 survive termination.
12. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. Nothing in these Terms excludes or limits any statutory right you have as a consumer that cannot lawfully be excluded.
13. Limitation of liability
To the fullest extent permitted by law, US Gatewaylist Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months before the claim arose. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be limited or excluded.
14. Indemnity
You agree to indemnify and hold harmless US Gatewaylist Ltd, its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Service, or violation of any law or third-party right.
15. Changes to these terms
We may update these Terms from time to time. We will post the revised Terms on this page with a new "Last updated" date, and, for material changes, provide additional notice (e.g. by email or an in-app notice). Continuing to use the Service after changes take effect means you accept the updated Terms.
16. Governing law
These Terms are governed by the laws of England and Wales. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer-protection law gives you the right to bring proceedings in your own country of residence.
